Justice James Omotosho of the Federal High Court sitting in Abuja has dismissed an ex parte motion filed on behalf of the detained leader of the outlawed Indigenous People of Biafra (IPOB), Nnamdi Kanu, which sought his relocation from the Sokoto Correctional Centre to a facility closer to the Federal Capital Territory.
The court, on Monday, ruled that the application was procedurally defective and therefore incompetent, striking it out.
The motion was filed by the Legal Aid Council of Nigeria (LACoN) through its counsel, Demdoo Asan, who also applied for leave of court to withdraw from representing Kanu, citing irreconcilable differences between him and the applicant.
While moving the application, Asan told the court that attempts to properly support the motion were unsuccessful because none of Kanu’s relatives appeared to swear to the affidavit in support of the request.
He explained that from December 8, 2025, he had been in repeated phone conversations with Kanu’s family members, urging one of them to come to his office to depose to the affidavit, but none turned up.
Asan further alleged that Kanu had been attempting to dictate how the case should be handled, a situation he said conflicted with his responsibilities as a legal practitioner and an officer of the court.
