The African Democratic Congress (ADC) has faulted the Economic and Financial Crimes Commission (EFCC) over its decision to revoke the bail earlier granted to former Attorney-General of the Federation and Minister of Justice, Abubakar Malami, SAN, describing the action as politically motivated rather than a genuine law-enforcement measure.
In a statement issued on Friday, the party said the EFCC’s move raises serious constitutional and procedural concerns, stressing that Malami has remained available to investigators and has not been formally arraigned or served with any court order indicating a breach of bail conditions.
The ADC argued that under Nigerian law, only a competent court has the authority to review or revoke bail, not an investigative agency acting unilaterally. It warned that actions taken outside judicial oversight amount to an abuse of power and weaken public confidence in the anti-corruption campaign.
According to the party, the timing of the bail withdrawal—coming amid Malami’s recent political engagements—fuels public suspicion that the EFCC is being deployed as a tool for political pressure rather than justice.
“Law enforcement must not be weaponised against political opponents,” the ADC said, adding that selective application of anti-graft measures threatens democratic stability and the credibility of state institutions.
The party called on the EFCC to either proceed transparently by filing charges before a court of law or restore the former minister’s bail in line with due process. It also urged Nigerians and party supporters to remain calm and law-abiding while lawful remedies are pursued.
The ADC reaffirmed its commitment to the rule of law and insisted that no citizen should be subjected to punitive measures without clear charges, judicial backing, and respect for fundamental rights.
