In a decisive ruling delivered by the Court of Appeal in Abuja on Friday, September 6th, 2024, an appeal filed by Arthur Osene challenging the candidacy of Dr. Asue Ighodalo, the People's Democratic Party (PDP) governorship candidate in Edo State, was dismissed. The case, identified as CA/ABJ/CV/863/2024, sought to bar Ighodalo and four others from the upcoming Edo gubernatorial election, set for September 21st, 2024.
Justice Barka, delivering the judgment, upheld the lower court’s decision, stating that the case was statute-barred. He affirmed that once a case is deemed to be statute-barred, the court lacks the jurisdiction to entertain it. With this ruling, the court reaffirmed Ighodalo as the validly nominated candidate of the PDP, paving the way for his participation in the forthcoming election.
This development is seen as a significant boost to the PDP’s campaign, as the legal hurdle against their candidate has now been removed, solidifying Ighodalo’s place on the ballot.
