NNPP Should Blame Itself First Before Blaming Anybody

What people, including some lawyers failed to understand is that, NNPP, Abba Kabir Yusuf (Gov.) and the only one witnesse presented by NNPP at the Tribunal made tremendous mistakes, negligence and recklessness which contributed to their failure in court.

People will keep on blaming the courts in this case until they go through the exercises, pleadings of both parties and their arguments.

NNPP and Abba had never expected that the challenge on membership can be an issue to them at the Trial, as a result of that they never took that area serious in their pleadings and other arguments which was very wrong and unprofessional. And by the time they realized their mistakes they were already late.

Do you know that Abba had never pleaded any documents in his reply at the Tribunal to establish his evidence of membership of NNPP?

And the implications of failure to plead a document in your reply in court is that, you can not in the process of presentation of evidence seek to present that document which you didn't previously plead in the reply, as your evidence in the court except by leave of court. This is certainly the legal process and procedure in court, ask any lawyer. And after realizing the need to present those documents of his evidence of membership by NNPP, they failed to seek the leave of court before tentering them, as a result of which the court attached not weight to the documents which is right in law.

Do you know that the only one witness presented by the NNPP and Abba urged the Tribunal to use the evidences presented by INEC in support of their case, which was at their own detriment ?

And there is one term (COURT IS NOT A FATHER CHRISTMAS), even if you are not a lawyer, I believe you are very much aware of it. What that means in short is COURT CAN'T DO SOMETHING YOU DIDN'T REQUEST. In other words, COURT IS NOT EXPECTED TO WORK FOR A PART IN ESTABLISHING HIS CASE. There are many other related meanings.

And in the documents of the Certified True Copy of the REGISTER OF MEMBERS of the NNPP presented by the APC before the Tribunal as her evidence, the name of Abba was not there as a member of the NNPP..... And it was not forged by INEC. That is how truly the register was submitted to INEC by the NNPP before the election.

THESE ARE PART OF THE ISSUES NOT KNOWN TO MANY PEOPLE.
